The Restore Online Shoppers Confidence Act (ROSCA), FTC's Negative Option Rule and California's "SB 340" prohibit any person from charging or attempting to charge any consumer for goods or services over the Internet through a negative option type plan (pre-notification plan, automatic billing plan, continuity type plan or "free-to-pay" plan, etc.) unless the person: (1) clearly and conspicuously discloses the material terms of the transaction before obtaining billing information; (2) obtains the consumer's express informed consent before charging the consumer; and (3) provides "simple mechanisms" for a consumer to stop recurring charges. If you offer automatic billing or other negative option type plans, you can include the appropriate disclosure in your website terms of service or digital product license.
